(1) A special post can be created in the following cases:-
(a) If an employee is delayed in reaching the office to which he is transferred due to circumstances manifestly beyond his control,
(b) If the transferee appears before the transferee has agreed,
(c) If an employee is not assigned to perform the duties of the former office,
(d) If any employee is engaged in training, scholarship, seminar etc.,
(e) If an employee takes leave for more than one month,
(f) If it is necessary to maintain the position of the employee who has fallen into disrepair while preparing the organizational structure of the ministry and the agencies under it.
(2) When creating a special position according to sub-rule (1), a decision must be taken from the secretary level of the ministry in the case of the authorized level position and from the relevant departmental head level in the case of the assistant level position with the prior consent of the Ministry of Finance and the Ministry of General Administration. However, in the case of clauses (a), (b) and (d) of sub-rule (1), if a special post is to be created for a period of less than one month, the consent of the Ministry of Finance and the Ministry of General Administration shall not be required.
(3) If the condition of sub-rule (1) does not exist, the special post so created shall automatically be cancelled.
